Residential pools in Newport Beach must meet safety requirements under the California Swimming Pool Safety Act (Health & Safety Code 115920-115929) and NBMC Title 15. New pools must include at least two of the following safety features: pool fencing, a listed safety cover, exit alarms on doors/windows opening to the pool, and self-closing/self-latching devices on access points. All pool and spa drains must comply with the Virginia Graeme Baker Pool and Spa Safety Act (federal law) with anti-entrapment drain covers and, for single-drain pools, a safety vacuum release system (SVRS). Pool equipment must be properly bonded and grounded per electrical code. Chemical storage must comply with fire code requirements. Pool water drainage cannot discharge to storm drains or Newport Harbor. Residential pools do not require lifeguards. The city does not mandate pool alarms on all pools, but alarms count toward the two-feature requirement for new construction.
Non-compliant drain covers or missing safety features are cited during inspections and must be corrected before final approval. Existing pools with outdated drain covers must be retrofitted. Draining pool water to storm drains violates NBMC stormwater regulations.
