All residential swimming pools and spas in Newport Beach must be enclosed by barriers meeting California Building Code (CBC) Section 3109 and the California Swimming Pool Safety Act (Health & Safety Code 115920-115929). Barriers must be at least 60 inches high measured from the exterior grade. Gates must be self-closing and self-latching, with latches at least 54 inches above grade (or secured to prevent child access). The barrier must not have openings that allow passage of a 4-inch sphere. Horizontal members that could serve as footholds must not be spaced to allow climbing. Walls of the dwelling may serve as part of the barrier if doors leading to the pool area have self-closing devices and alarms. Removable mesh fencing meeting ASTM F2286 standards is accepted as a barrier. Pool covers alone do not satisfy barrier requirements. Inspections of barriers are required before the pool passes final inspection. The Community Development Department enforces these requirements.
Pool barrier deficiencies identified during inspections prevent final permit approval. Existing pools found without adequate barriers are subject to code enforcement action with notices to comply. Failure to maintain barriers after a child drowning or near-drowning can result in criminal liability.
