Irvine, CA Swimming Pools & Spas: Fencing & Safety Requirements (2026)

Irvine Municipal Code § 5-9-401(E)(1) rewrites California Building Code § 3109 (incorporating Health & Safety Code § 115922) to set a two-layer drowning-prevention standard for private single-family pools and spas triggered at the moment a construction or remodeling building permit is issued. Layer one is mandatory: an enclosure meeting Health & Safety Code § 115923 that isolates the pool from the home, with any residential walls used to complete the isolation meeting the same door/window protection standards. Layer two requires at least one additional feature chosen from a defined list: ASTM F2286-rated removable mesh fencing with a self-closing, self-latching, key-lockable gate; a manually or power-operated safety cover certified to ASTM F1346-23; exit alarms on doors and windows that give direct access to the pool, sounding audibly or with a repeating verbal warning whenever opened; a self-closing, self-latching door device mounted at least 54 inches above the floor; or a submersion alarm independently certified to ASTM F2208 (excluding wearable child-alarm devices, which do not qualify).

The code bars combining an exit alarm with a self-latching device on the same door, an exit alarm with a door latch on separate doors, or a safety cover with a submersion alarm as the two required layers, those pairings do not satisfy the standard. Before final approval of the permitted construction or remodel, the building official must personally inspect the installed drowning-prevention features and can withhold final sign-off until the pool is compliant.
