Mission Viejo enforces California's swimming pool barrier requirements mandating that all residential pools and spas be enclosed by approved safety barriers. Fencing must be at least 60 inches high with self-closing, self-latching gates to prevent unsupervised child access.
Under California Building Code Section 3109 and Health & Safety Code Section 115920-115929, all residential swimming pools and spas in Mission Viejo must be equipped with at least one approved safety feature. The most common is an isolation fence or barrier at least 60 inches high surrounding the pool area. Gates must be self-closing and self-latching with the latch mechanism at least 54 inches above grade. Fence openings must not allow passage of a 4-inch sphere. Alternatively, homeowners may use approved pool covers meeting ASTM standards, pool alarms, or self-closing door alarms on all house exits leading to the pool. New pool construction requires barrier compliance before the pool is filled. Existing pools must also maintain compliant barriers.
Non-compliant pool barriers may result in stop-work orders during construction, failure of final inspection, administrative citations, and potential liability exposure. The city can require immediate corrective action.
