Pool barrier requirements in Fullerton follow California Building Code (CBC) Section 3109 and Health and Safety Code Sections 115920-115929, which establish minimum safety standards for residential swimming pools and spas. Every outdoor swimming pool, spa, or hot tub must be surrounded by a barrier at least 60 inches (5 feet) in height measured from the exterior finished grade. The barrier must not have openings, handholds, or footholds that would allow a young child to climb through or over it. Vertical fence members must be spaced no more than 4 inches apart (1.75 inches for chain-link fence). Horizontal members that could serve as a ladder must be spaced at least 45 inches apart or positioned on the pool side of the fence. All gates must be self-closing and self-latching, with the latch located at least 54 inches above the ground or, if lower, on the pool side of the gate at least 3 inches below the top. Gates must open outward, away from the pool. In addition to the perimeter barrier, California law requires at least one supplemental safety feature from the following list: an approved safety pool cover meeting ASTM F1346, a pool alarm that activates when an object exceeding a certain weight enters the water, door alarms on all home exits providing direct access to the pool area, or self-closing and self-latching devices on all home doors leading to the pool. The Building Division verifies barrier compliance as part of the pool permit inspection process, and barriers are also checked during property resale inspections when applicable.
Non-compliant pool barriers are a serious safety violation. The Building Division may issue a correction notice requiring immediate remediation. Failure to install required barriers can result in a stop-work order on pool construction, refusal to pass final inspection, and administrative citations. Property owners with existing pools that lack compliant barriers may face code enforcement action. In the event of a drowning or injury, non-compliant barriers may also create civil liability.
