Pools and spas in Orange must be enclosed by a fence or wall at least 5 feet high with self-closing, self-latching gates per California Building Code Section 3109 and Orange County Ordinance 19-006. A secondary barrier is also mandatory.
Under California Building Code Section 3109 and Orange County Ordinance 19-006, all pools and spas must be completely enclosed by a fence or wall at least 5 feet in height measured from outside the pool area. Gates and doors within the barrier must be self-closing and self-latching with latches at least 5 feet above grade, swinging outward from the pool area. Wrought iron fencing may not have openings wider than 4 inches. A secondary barrier is required, which may be: a removable mesh fence located at least 20 inches from the water edge with a self-closing, self-latching gate accommodating a key lock; a safety pool cover meeting ASTM F1346 standards; a pool alarm monitoring entry into the water; or other means providing equal or greater protection as approved by the building official. Requirements apply to new pools and when existing pools undergo substantial modification.
Non-compliant pool fencing is a life-safety violation subject to immediate code enforcement, correction orders, and fines. Permit final inspection cannot be passed without compliant barriers.
