Tustin requires no permit for a garage sale. Residents may hold up to 4 garage sales per year, each lasting a maximum of 3 consecutive days, and may sell only their own merchandise. Sign rules limit size, placement, and timing.
The City of Tustin's published FAQ sets out the rules for residential garage and yard sales, governed by the Tustin City Code and enforced by Code Enforcement. No permit is required to hold a garage sale in Tustin. Residents may hold a garage sale 'a total of 4 times a year,' and 'a single garage sale may extend a maximum of 3 consecutive days.' Only merchandise belonging to the owner may be sold, so the rules are meant for personal household goods, not ongoing retail or resale operations. The City also regulates garage-sale signage: signs 'shall not be erected more than 1 day in advance' of the sale and 'shall be promptly removed by sunset on the last day of the sale.' Each sign 'may be no larger than 3 square feet in area and no taller than 4 feet in height.' Signs may not be attached to any traffic or parking control device, tree, street light, or utility pole, and may not be placed so as to obstruct public sidewalks; instead, the City says signs 'should be placed on a stake and placed into the ground.' Signs posted illegally will be removed by the City. These are city-specific rules; there is no separate Orange County garage-sale permit for properties inside Tustin.
Holding more than 4 garage sales in a year, running a single sale longer than 3 consecutive days, selling goods that don't belong to the owner, or posting signs that are too large, posted too early, left up after the sale, or attached to poles/trees/traffic devices violate the City's rules. Illegally posted signs are removed by the City.
