ROH Section 40-7.4, within Chapter 40 Article 7, is Honolulu's primary blight-enforcement tool. The Director of the Department of Planning and Permitting may issue notice to an owner or occupant when weeds, garbage, trash, or waste on a property constitute a fire hazard, vermin harborage, or public nuisance. The owner has 30 days to cut and remove the material. If not done, the city may enter, abate the condition, and bill the owner. Unpaid costs become a lien against the property and accrue 7 percent interest annually until paid. Owners have appeal rights under the chapter's administrative procedures.
Failure to comply with a cleanup notice leads to city abatement at owner expense, a recorded lien, and can result in additional civil fines for repeat or hazardous conditions.
