Owners of vacant land must still control noxious weeds and refuse. Greeley's code makes it the duty of every owner of a vacant lot to keep it clean and orderly; unincorporated Weld vacant land falls under the county's noxious-weed and zoning rules.
Vacant parcels are not exempt from maintenance duties. In Greeley, Section 12-269 imposes on every owner, agent or tenant of any building, premises or vacant lot the duty to keep it in a clean and orderly condition, permitting no accumulation of refuse or litter beyond ordinary use. In unincorporated Weld County there is no general 'grass height' rule, but the Weld County Noxious Weed Management Enforcement Policy (Chapter 15) requires all landowners to manage designated noxious weeds on vacant tracts, and dumping refuse on a vacant lot is unlawful. The county can control weeds and assess the whole cost, plus up to 20% for inspection, against the land as a lien if the owner fails to act.
Greeley refuse accumulation on a vacant lot is a code infraction (Title 1, Ch. 10). Weld County can abate uncontrolled noxious weeds and lien the whole cost, plus up to 20% incidentals, against the parcel.
