Under Neb. Rev. Stat. 76-1437, either party may end a month-to-month tenancy with at least 30 days' written notice before the periodic rental date, and a week-to-week tenancy with at least 7 days' written notice. A fixed-term lease ends on its own date without further notice.
Neb. Rev. Stat. 76-1437 governs ending periodic tenancies under the URLTA. It states the landlord or tenant may terminate a month-to-month tenancy 'by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice,' and a week-to-week tenancy with at least seven days' written notice. The notice must be in writing and properly delivered. A fixed-term lease expires on its stated end date and generally needs no termination notice unless the lease says otherwise. These periodic-notice rules are separate from for-cause termination (nonpayment or breach) handled under 76-1431.
No specific statutory penalty. A termination attempted on short or improper notice is simply ineffective; the tenancy continues until a proper notice period runs.
