Under Ark. Code 18-17-704, 'the landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty (30) days before the termination date,' and a week-to-week tenancy by at least 7 days' written notice. A fixed-term lease ends on its stated date; breaking it early exposes the tenant to liability for remaining rent, subject to the landlord's duty to mitigate. Active-duty servicemembers may terminate a residential lease under the federal Servicemembers Civil Relief Act, 50 U.S.C. 3955, on deployment or PCS orders with written notice and a copy of the orders. Arkansas has not enacted a general statute letting domestic-violence survivors terminate a lease early without penalty, so any such relief depends on lease terms or a court order.
No specific statutory penalty for the landlord. A tenant who breaks a fixed-term lease early may owe the balance of rent owed under the lease, reduced by the landlord's reasonable re-rental efforts.
