California Civil Code 1946.2(d) sets the statewide minimum relocation amount for AB 1482 no-fault evictions at one month's rent, payable within fifteen days of notice or waivable as the final month. The amount is based on current rent at the time of notice. Unlike Los Angeles, San Francisco, or Santa Monica which layer enhanced relocation based on household composition (seniors, minors, disability), Orange County has not adopted higher county-level amounts for unincorporated areas. Some incorporated OC cities may impose additional protections; tenants should verify city-specific rules. Failure to deliver relocation voids the eviction notice.
Failing to pay or waive relocation, paying after the eviction concludes, or miscalculating the amount based on outdated rent figures can void the eviction, trigger restitution claims, and award attorney's fees.
