Both small and large family daycare homes require a license from the California Department of Social Services Community Care Licensing Division (CCL). Licensing requirements include criminal background checks, health screenings, CPR and first aid certification, fire clearance from OCFA, compliance with child-to-staff ratios, and adherence to indoor and outdoor space requirements. The CCL conducts announced and unannounced inspections. Operators must also obtain a Mission Viejo business license.
Operating a daycare without a CCL license is a misdemeanor under California law with fines up to $1,000 per day. Operating a large family daycare without a city use permit may result in code enforcement action and orders to cease operations. Licensed operators who violate CCL standards may receive citations, civil penalties of $50 to $150 per day per violation, or license revocation.
