LUO Section 21-5.730, added by Ordinance 22-7 (Bill 41 of 2021), controls bed and breakfast homes and transient vacation units countywide. Rentals under 90 consecutive days require annual registration with the Department of Planning and Permitting, with a $1,000 initial fee and $500 renewal. New transient vacation units are limited to resort-zoned areas, and legally existing nonconforming short-term units outside resort zones may continue only with a DPP nonconforming use certificate. Owners must display registration numbers in advertising, keep guest logs, and designate a local contact. Long-term residential rentals are not registered.
Operating an unregistered short-term rental can draw daily fines starting at $1,000 under LUO enforcement, registration revocation, and cease-and-desist orders from DPP.
