Texas has no statewide rental-registration mandate, and counties lack zoning authority under Local Government Code Ch. 231 to create one for unincorporated areas. Attempts by Texas cities to require across-the-board rental registration have been repeatedly challenged under HB 1118 and constitutional search-and-seizure grounds (see City of Dallas registration litigation). Conroe, Willis, and Magnolia do not operate general long-term rental registration. Short-term rentals may be captured under separate hotel occupancy tax collection (Tax Code §351) but that is not the same as habitability registration. Landlord duties under Property Code §92.052 (repairs), §92.101 (security deposits), and §92.153 (smoke alarms) apply regardless of registration. The Woodlands Residential Covenants require rental properties to comply with the same standards as owner-occupied homes and may require tenant information be provided to the HOA.
Failure to maintain smoke/CO detectors per §92.153: $100 plus one month's rent plus attorney fees per unit. Security-deposit violations §92.109: three times the withheld amount plus $100. No general registration fine.
