Neither Kansas nor Wichita lists source of income as a protected class. Landlords may legally refuse Section 8 vouchers and other public assistance when screening prospective tenants.
The Kansas Act Against Discrimination, KSA 44-1015 et seq., prohibits housing discrimination based on race, religion, color, sex, disability, national origin, ancestry, and familial status, but does not include source of income. Wichita Code does not add this protection either. As a result, Wichita landlords may legally refuse to accept Section 8 Housing Choice Vouchers, Veterans Affairs Supportive Housing vouchers, or general public assistance during tenant screening. Voucher acceptance by a landlord remains entirely voluntary. Federal fair housing law does prohibit discrimination on race, disability, and other federal protected classes, regardless of voucher status.
While voucher refusal is legal in Wichita, refusing housing because of a protected class such as race, disability, or familial status can trigger federal HUD complaints and Kansas Human Rights Commission investigations.
