Kansas Statute 12-1650 and KDA cottage food rules allow Wichita residents to sell home-baked non-potentially-hazardous foods directly to consumers without licensing or kitchen inspection. Required labeling discloses the home preparation and lists ingredients and allergens.
Kansas allows cottage food production under K.S.A. 12-1650 and Kansas Department of Agriculture (KDA) guidance. Wichita home cooks may sell baked goods, jams and jellies, dry mixes, candies, granola, dried herbs, and other foods that do not require time or temperature control for safety directly to the end consumer. Sales channels include farmers markets, roadside stands, in-home pickup, and direct delivery; sales to retail stores, restaurants, or for resale are not allowed under cottage food rules. There is no annual sales cap and no kitchen inspection requirement. Each product must be labeled with the producer name and address, product name, ingredient list in descending order of weight, allergen disclosure for the major allergens, net weight, and the statement that the food was produced in a home kitchen not subject to state inspection. Foods requiring refrigeration including meat products, cheesecakes, cream-filled pastries, canned vegetables, salsa, pickles, and any low-acid canned good are prohibited. Selling at the Old Town Farmers Market or Kansas Grown Farmers Market does not require additional city licensing for cottage food, but commercial vendors do need a city peddler permit.
