Under ARS 9-500.39, Arizona cities cannot prohibit short-term rentals or limit them to owner-occupied uses. Tucson registers operators under Tucson Code Chapter 7, Article X-A but cannot require the owner or a designated host to live on the premises during a guest stay. Whole-house rentals through Airbnb, Vrbo, and similar platforms are permitted citywide subject only to general zoning, registration, occupancy, noise, and parking standards. The city does require an in-state emergency contact reachable within one hour of any complaint, which substitutes for an actual on-site host.
Operating without a registration certificate or failing to provide a 24/7 local emergency contact may result in suspension of the STR permit and civil fines up to $1,500 per stay.
