The City of Tucson does not require a dedicated short-term rental permit or vacation rental license. Operators need only the standard Tucson business license and the Arizona Transaction Privilege Tax (TPT) license issued by the Arizona Department of Revenue. State law (A.R.S. Section 9-500.39) sharply limits how Arizona cities may regulate short-term rentals.
Tucson has not adopted a stand-alone short-term rental ordinance or vacation rental permit program. To operate an STR (a residential rental of less than 30 days) in Tucson, an owner must: (1) hold a City of Tucson business license (initial fee approximately $25, with a $70 annual renewal); (2) hold an Arizona Transaction Privilege Tax (TPT) license from the Arizona Department of Revenue and remit the state TPT/transient lodging tax (5.5% state TPT plus county and city excise components) on gross rental receipts; (3) register the property with the Pima County Assessor as residential rental property; and (4) comply with general health and safety requirements. Under A.R.S. Section 9-500.39, Arizona cities cannot prohibit short-term rentals or restrict them based on classification, use, or occupancy. After Senate Bill 1168 (2022), cities may adopt limited permit programs and health and safety standards, but Tucson has chosen not to enact a city-specific STR permit. Owners should also check HOA/CC&R restrictions, which can prohibit short-term rentals even where the city does not.
There is no Tucson STR permit, so there is no penalty for failing to obtain one. Failure to hold a Tucson business license can result in city business-tax enforcement, and failure to hold the Arizona TPT license or remit the transient lodging tax is enforced by the Arizona Department of Revenue with civil penalties and interest under A.R.S. Title 42. HOA violations are enforced privately under the recorded CC&Rs.
