Fishers' published UDO 5.4.6 does not set an annual night cap on short-term rentals. Indiana defines an STR as a rental for terms of less than 30 days, and IC 36-1-24 bars cities from interpreting zoning to prohibit or unreasonably restrict STRs — limiting any hard night cap.
Indiana Code 36-1-24-6 defines a short-term rental as a rental for terms of less than thirty (30) days at a time through a short-term platform — the per-stay duration line, not an annual cap. Fishers' UDO Section 5.4.6 does not publish a separate annual night limit for short-term rentals; the visible standards instead cap bed-and-breakfast stays at no more than 30 consecutive days per guest. State law constrains how far the City could go: IC 36-1-24-9(b) prohibits interpreting and enforcing zoning rules in a manner intended or having the effect of prohibiting or unreasonably restricting STRs, which makes a low hard annual night cap legally vulnerable, particularly for owner-occupied STRs that are permitted by right under IC 36-1-24-8. A booking that runs 30 days or longer falls outside the STR definition and is treated as a longer-term rental (potentially within the scope of the Chapter 163 home-rental program). Confirm current limits with Fishers Planning & Zoning, since 2026 state law (HEA 1210) further restricts local rental caps.
Because no STR annual night cap is published, there is no night-cap violation to enforce. Renting for stays of 30 days or more simply moves the rental out of the STR category. Any future cap would still be subject to the IC 36-1-24-9(b) bar on unreasonable restriction.
