Schenectady County does not cap STR nights. City of Schenectady's rental registry does not currently impose a maximum-rental-night rule. State law treats stays over 30 consecutive days as traditional tenancies exempt from occupancy tax.
Unlike some NY localities, Schenectady County has no cap on the number of nights a home may operate as an STR each year. The 30-night rule in NY Tax Law makes longer stays non-taxable hotel rentals and shifts them to traditional tenant-landlord law under the RPAPL. The state's Ch. 739/2024 STR framework also defers night caps to local governments. Non-primary-residence STRs remain unregulated on that metric.
