Utah County, UT Short-Term Rentals: Occupancy Limits (2026)

Provo City Code §14.34 (Short Term Rentals) limits STR guest occupancy to 2 persons per bedroom plus 2 additional, with an absolute cap of 10 regardless of bedroom count. Orem Code §22 STR provisions cap occupancy at bedroom count plus 2 with registration through the city. Utah County's Land Use Ordinance in unincorporated areas requires STR registration and imposes IBC-based occupancy (one occupant per 70 square feet of sleeping area). All three jurisdictions prohibit sleeping in garages, accessory structures without a kitchen and bath, tents, RVs, or vehicles on the STR property. Hosts must post maximum occupancy inside the unit and on the listing. Provo's STR ordinance also aligns with the city's single-family zoning rule barring more than 3 unrelated adults in R1 zones — a rule that applies 365 days a year and carries enhanced BYU-area enforcement. The Utah Transient Room Tax (§59-12-301, 4.25%) plus local TRT and sales tax apply to all STRs.
