Occupancy for short-term rentals in Brooklyn is governed by New York State Multiple Dwelling Law Β§4(8) and NYC Local Law 18 of 2022. For any stay of fewer than 30 consecutive days in a Class A dwelling (a building intended for permanent residence, which covers most Brooklyn brownstones, co-ops, condos, and apartments), the host must: be the permanent occupant, be physically present during the guest's entire stay, host no more than 2 paying guests at a time, and keep all interior doors unlocked so guests have free passage throughout the unit. Rent-stabilized units cannot be used as STRs. Class B buildings (single-room occupancy, hotels) can legally host stays under 30 days but are not general housing. Buildings with prior Class A certificates of occupancy cannot be 'converted' to transient use without a full DOB re-classification. The OSE maintains a Prohibited Buildings List for buildings whose owners have opted out. Occupancy beyond the 2-guest cap, absent-host rentals, and whole-unit rentals are all illegal.
