Red Bank, NJ Short-Term Rentals: Occupancy Limits (2026)

Chapter 559 of the Red Bank Borough Code (adopted 5-23-2024 by Ordinance No. 2024-23, replacing the original 2-8-2023 Ordinance 2023-02 that was vetoed and overridden) limits short-term rentals to owner-occupied premises only and to rental terms of 28 consecutive days or fewer. Eligible structures are owner-occupied single-family homes, duplexes, and up to two units in a multifamily building. Chapter 559 does not codify a separate two-per-bedroom or similar numeric cap; instead, total occupancy is bounded by the New Jersey Uniform Construction Code (NJAC 5:23) habitable-space rules, which generally require at least 70 square feet for the first occupant of a sleeping room plus 50 square feet for each additional occupant, plus minimum room dimensions. Operators must register the property as a commercial entity with the Borough and obtain an STR permit from the Red Bank Fire Marshal's Office (732-530-2700 ext. 0) before renting or advertising.
