Red Bank Borough Code Chapter 559 (adopted by Ordinance 2024-23, May 23, 2024) restricts short-term rentals to owner-occupied single-family homes, duplexes, or up to two units in a multifamily building, for stays of no more than 28 consecutive days. The borough does not publish a separate per-bedroom occupancy cap; the unit must comply with the New Jersey Uniform Construction Code habitable-space minimums.
Chapter 559 of the Red Bank Borough Code (adopted 5-23-2024 by Ordinance No. 2024-23, replacing the original 2-8-2023 Ordinance 2023-02 that was vetoed and overridden) limits short-term rentals to owner-occupied premises only and to rental terms of 28 consecutive days or fewer. Eligible structures are owner-occupied single-family homes, duplexes, and up to two units in a multifamily building. Chapter 559 does not codify a separate two-per-bedroom or similar numeric cap; instead, total occupancy is bounded by the New Jersey Uniform Construction Code (NJAC 5:23) habitable-space rules, which generally require at least 70 square feet for the first occupant of a sleeping room plus 50 square feet for each additional occupant, plus minimum room dimensions. Operators must register the property as a commercial entity with the Borough and obtain an STR permit from the Red Bank Fire Marshal's Office (732-530-2700 ext. 0) before renting or advertising. Confirm any per-bedroom or per-permit occupancy figure with the Fire Marshal's Office before listing.
Renting a non-owner-occupied unit, exceeding 28 consecutive days, or operating without a current Fire Marshal STR permit violates Chapter 559. The borough may revoke the permit and pursue municipal court penalties under the general violations provisions of the Red Bank Borough Code. Confirm current penalty schedule with the Fire Marshal's Office.
