New Jersey's 2018 "Airbnb" law taxes transient accommodations obtained through a marketplace (Airbnb, Vrbo) or that are professionally managed. Such rentals owe the 6.625% state Sales Tax and the 5% State Occupancy Fee (N.J.S.A. 54:32D-1). Municipalities may adopt a Municipal Occupancy Tax up to 3% by ordinance. Unlike Cape May, Passaic County has no county-wide occupancy tax; the county authority under N.J.S.A. 40:48E is exercised municipally. Rentals booked directly from the owner that are not professionally managed (owner offers fewer than three units) are exempt from Sales Tax and the occupancy fees.
The NJ Division of Taxation enforces state occupancy taxes; marketplaces generally collect and remit on the host's behalf. Unremitted tax accrues interest and penalties. Municipal occupancy-tax noncompliance is enforced under the adopting town ordinance.
