The City of Johns Creek 'levies an excise tax of 7% of the rent for every occupancy of a guest room in a hotel, rooming or lodging house, inn, motel, motor hotel and court, cabin, public or private club, and tourist camp' that regularly furnishes guest rooms for value. This local hotel/motel tax is authorized under Georgia's accommodations-tax statute, O.C.G.A. 48-13-51. On top of the city tax, Georgia applies its statewide sales and use tax and a state hotel-motel fee of $5 per night for lodging stays under 30 consecutive days (O.C.G.A. 48-13-50.3). Importantly, paying these taxes does not legalize a short-term rental in a residential zone where the use is not permitted. Failure to remit the 7% city tax by the due date incurs a 10% penalty and 1% monthly interest. Operating taxable lodging without remitting can prompt collection action; the underlying residential STR use may also be cited as a zoning violation.
