NYC Admin Code 19-136 and 34 RCNY Chapter 2 require an 8-foot clear pedestrian path. Queens store displays cannot extend past 3 feet from the building line.
Queens sidewalks must be kept clear for pedestrian passage. NYC Admin Code 19-136 makes it unlawful for any person to obstruct a sidewalk, and 34 RCNY 2-02 requires a minimum clear pedestrian path width, generally 8 feet for most sidewalks and narrower in residential districts. Common Queens obstruction issues include: retail stores on Roosevelt Avenue, Steinway Street, Main Street Flushing, and Jamaica Avenue displaying merchandise too far from the building line; restaurants placing signs and menu boards that impede the walking path; construction sheds and scaffolding that narrow the walkway below required widths; and residential properties stacking trash, construction debris, or oversized bulk items on the sidewalk outside legal collection windows. Merchandise displays by a store owner generally cannot extend more than 3 feet out from the building, cannot exceed 5 feet in height, and cannot block required fire exits or subway grates. Sidewalk cafes require separate approval (see sidewalk-cafe sub). Construction shed permits are issued by DOB and must maintain a minimum 5-foot clear path at night and 8 feet during normal hours. DSNY enforcement addresses obstruction by dirty conditions, tied directly to trash placement rules. Revocable Consents from DOT are required for almost any permanent non-governmental structure in the public right-of-way, including bollards, planters, and under-sidewalk vaults. Queens commercial strips with active enforcement include LIC's Vernon Boulevard, Forest Hills' Austin Street, Bayside's Bell Boulevard, and Woodside 61st Street.
DOT and DSNY sidewalk obstruction fines range 250 to 2,000 dollars for first offense; commercial violations can reach 10,000 dollars. Construction obstruction: DOB civil penalties up to 25,000 dollars plus stop-work orders. Merchandise over-display: DCWP violations starting at 500 dollars.
