Palm Coast Chapter 16, Article V (Garage Sales) prohibits all off-site or off-premise garage-sale signs — signs may only be posted on the property hosting the sale. Chapter 12 (Signs and Advertising) of the Unified Land Development Code separately bans all signs (except governmental signs) in any public right-of-way, swale, median, or attached to utility poles, traffic signs, trees, or fences. Off-premise signs may be removed immediately by Code Enforcement or Public Works. Violations are cited through Palm Coast Code Enforcement and adjudicated by the Special Magistrate under FS Chapter 162.
Palm Coast's garage-sale sign rules sit at the intersection of Code Chapter 16 (Businesses, Business Regulations), Article V (Garage Sales), and Unified Land Development Code Chapter 12 (Signs and Advertising). Under Chapter 16 Article V, off-site signs are prohibited — a homeowner conducting a garage sale may post signs only on the property where the sale is being held, with the property owner's permission, and may not post directional signs at intersections, in adjacent neighborhoods, or anywhere off the sale property. Chapter 12 (Signs) reinforces this: all signs in any public right-of-way, swale, median, or other public property are prohibited, with the sole exception of governmental signs (the city adopted this uniform ban to comply with Reed v. Town of Gilbert (2015)). Chapter 12 also prohibits attaching signs to street lamp posts, traffic signs or signals, fire hydrants, trees, shrubs, fences, or utility poles. Any off-premise garage-sale sign may be removed immediately by Palm Coast Code Enforcement, Public Works, or the Flagler County Sheriff's Office, without prior notice. Signs on the sale property must be removed promptly when the sale ends. Garage sales themselves require a permit issued by Code Enforcement (no fee) under Chapter 16 Article V and are limited to two sales per calendar year per property, two consecutive days each, between 8:00 a.m. and 4:00 p.m. (see related entry on Garage Sale Rules). Violations of the sign or sale rules are processed through Palm Coast Code Enforcement (386-986-3764) and adjudicated by the Special Magistrate under Chapter 17 and FS Chapter 162. The Special Magistrate may impose fines of up to $250 per day for a first violation and up to $500 per day for a repeat violation under FS 162.09.
Off-premise signs in the right-of-way or attached to utility poles may be removed immediately without notice. Other violations cited through Code Enforcement; Special Magistrate fines up to $250/day first violation, $500/day repeat (FS 162.09).
