On private property with the owner's consent, Texas law bars a city from prohibiting a political sign, charging a fee, or restricting its size (up to 36 sq ft, 8 ft tall, not illuminated). HOAs must allow signs from 90 days before an election.
Texas Election Code §259.003 protects political signs on private real property statewide: a municipality may not prohibit the sign, require a permit or fee, or restrict its size. The protection stops if the sign has an effective area over 36 square feet, is more than 8 feet high, is illuminated, or has moving elements. Under §259.002 a property owners' association may not ban yard signs on or after the 90th day before an election through the 10th day after, though it may require ground mounting and limit one sign per candidate or measure. Signs in a highway right-of-way remain illegal and TxDOT can remove them.
TxDOT may remove signs placed in a state highway right-of-way without notice (Transportation Code Ch. 393); improper HOA enforcement can be challenged under the Election Code.
