Under Montgomery County Zoning Ordinance Chapter 59, Division 6.7, political signs on private property are exempt from the general sign permit requirement. In residential zones, signs may not exceed 32 square feet in total area per lot. Signs may be placed up to 45 days before an election and must be removed within 10 days after the election. Political signs may not be placed on public property, in the public right-of-way, or on utility poles. The county Board of Elections enforces state election law provisions regarding sign placement near polling places (no signs within 100 feet of a polling place entrance on election day per Maryland Election Law 16-206). Content-based distinctions in sign regulation were constrained by the US Supreme Court decision in Reed v. Town of Gilbert (2015).
Signs in the public right-of-way are subject to removal by the county without notice. Signs not removed within 10 days after an election may be cited under the zoning code. Fines for sign violations start at $100.
