California SB 270 and SB 1046 ban single-use plastic carryout bags at all Anaheim grocery, pharmacy, convenience, and liquor retailers, requiring a minimum ten-cent charge for any reusable or recycled paper bag provided.
Under California Public Resources Code 42281 et seq., Anaheim retailers covered by the law cannot give customers thin plastic carryout bags. They must instead sell either certified reusable bags meeting durability and recycled-content thresholds or paper bags with at least forty percent post-consumer recycled content. The minimum charge is ten cents per bag, retained by the retailer to offset costs. SB 1046 (2024) further tightens standards by phasing out the thicker reusable plastic bags by 2026. WIC and CalFresh customers are exempt from the bag fee. Restaurants and clothing retailers are not currently covered.
Providing a non-compliant single-use plastic bag, failing to charge the minimum bag fee, or misreporting the charge can result in civil penalties up to $5,000 per violation under state enforcement.
