These associations are governed by the Davis-Stirling Common Interest Development Act at California Civil Code 4000 and following. Board meetings must be open to members with at least four days advance notice of regular meetings and two days notice of executive sessions. Agendas must be posted and boards generally cannot take action on items not listed on the agenda. Executive sessions are limited to litigation, member discipline, personnel, contracts under negotiation, and certain foreclosure matters. Minutes of open meetings must be available to members within 30 days. Members have the right to speak during member comment periods. Emergency meetings can be called without notice only for true emergencies documented in minutes. Annual meetings and elections follow separate election rules with inspectors of elections and secret ballots.
