Under California Public Resources Code section 42270, full-service dine-in restaurants in Anaheim cannot proactively offer or place plastic straws at the table. Servers may provide a plastic straw only when the customer asks for one, and quick-service restaurants and drive-throughs are exempt from the request-only rule though strongly encouraged to follow it. The law was the first statewide straw-on-request mandate in the United States. Anaheim has no separate stricter local rule. Disability accommodation overrides the restriction: anyone needing a straw for medical reasons receives one immediately without question.
First and second violations within a calendar year warrant warnings; subsequent violations result in fines up to $25 per day with a $300 maximum annual penalty assessed against the dine-in restaurant.
