Public Resources Code 42281 et seq. bans single-use plastic carryout bags at California grocery stores, pharmacies, convenience stores, and large retailers. Twain Harte's Eproson Park area markets and gas station stores must offer only recycled paper bags, compliant reusable plastic bags, or compostable bags, charging at least 10 cents per bag. Customers using SNAP/WIC are exempt from the fee. SB 1053 (2024) further tightens rules starting in 2026, eliminating the thicker reusable plastic film bags. Restaurants and produce bags are not covered by the carryout bag rule.
Retailers face $1,000 first violation, up to $5,000 for ongoing violations, enforced by city or county attorneys.
