Tuolumne County Building and Safety enforces the Swimming Pool Safety Act through its adoption of the 2022 California Building and Residential Codes. Health and Safety Code Section 115922 requires a new or remodeled residential pool or spa at a single-family home to include at least two of seven approved features: an isolation enclosure, removable mesh fencing meeting ASTM F2286 with a self-closing self-latching gate, an ASTM F1346 safety pool cover, exit alarms on doors with direct access to the pool, a self-closing self-latching device on the door with release at least 54 inches above the floor, an ASTM F2208 swimming protection alarm, or other approved means providing equivalent protection. Section 115923 requires the isolation barrier to be at least 60 inches tall, no more than 2 inches above ground at the bottom, prevent passage of a 4-inch sphere, have no climbable surface, and have a gate that opens away from the pool with a self-latch at least 60 inches above the ground. Section 115924 requires inspection by the local building official before final approval.
A new or remodeled residential pool that does not include at least two HSC 115922 features will fail Tuolumne County Building inspection, which can support a stop-work order. Barriers shorter than 60 inches, gate latches under 60 inches, or barriers failing the 2-inch or 4-inch sphere rules in Section 115923 also fail inspection.
