Twain Harte pool barriers follow California's statewide Swimming Pool Safety Act (Health & Safety Code Β§Β§115920-115929) and California Building Code Β§3109, enforced locally by Tuolumne County Building & Safety. Pools deeper than 18 inches require a 60-inch enclosure with self-closing, self-latching gates and a latch at least 60 inches above grade. New or remodeled pools must have at least two of seven approved drowning prevention features.
Because Twain Harte is unincorporated, the Tuolumne County Building Division administers permits and inspections. California H&S Code Β§115923 sets the barrier standard: minimum 60 inches high; vertical clearance from ground to bottom of the enclosure no greater than 2 inches; no openings or gaps that allow passage of a 4-inch sphere; and access gates with a self-latching device placed no lower than 60 inches above the ground. H&S Code Β§115922 requires that whenever a building permit is issued for construction of a new pool or spa, or for remodel of an existing pool or spa, the pool be equipped with at least two of these seven drowning prevention features: (1) a four-sided enclosure meeting Β§115923; (2) removable mesh fencing meeting ASTM F2286 with a self-closing/self-latching gate; (3) a safety pool cover meeting ASTM F1346; (4) exit alarms on doors providing direct access to the pool; (5) a self-closing, self-latching device on doors with the release at least 54 inches above the floor; (6) a pool alarm meeting ASTM F2208; or (7) other independently certified means equally protective. Certain combinations are prohibited under Β§115922(b). California Building Code Β§3109 incorporates these standards into the building permit process, and Tuolumne County adopts the CBC by reference in its building regulations. Inspectors verify the barrier and the two required features before issuing final approval.
Failure to install a compliant barrier or the two required safety features will block final inspection on a new or remodeled pool. Tuolumne County Code Compliance (Chapter 1.10) can issue notices of violation, daily administrative fines, and abate unsafe pools as a public nuisance.
