Public Resources Code 42270 et seq. (AB 1276) prohibits food facilities from automatically providing single-use foodware accessories. Twain Harte cafes, lodges, and pizza shops must withhold plastic forks, knives, spoons, chopsticks, condiment packets, cocktail picks, and straws unless the customer requests them. Third-party delivery apps like DoorDash must default these items to off. Reusable items provided for on-site dining are exempt. Tuolumne County Environmental Health enforces during routine restaurant inspections and may issue notices of violation, escalating to fines after a written warning.
First two violations get warnings; third and later are infractions with $25 daily fines up to $300 per year per facility.
