Virginia's expanded polystyrene foam container ban was deferred by the General Assembly. Fairfax County does not currently restrict foam takeout containers because Dillon's Rule limits independent county action.
Virginia Code Section 10.1-1424.3, originally enacted in 2021, scheduled a statewide phase-out of expanded polystyrene foam food service containers beginning with the largest chains. The General Assembly later delayed the implementation timeline, and full enforcement has not yet begun. Because Virginia is a Dillon's Rule state, Fairfax County cannot adopt its own foam ban without explicit state authorization. Restaurants and food trucks operating in Fairfax may still legally use foam clamshells, cups, and trays. Some local businesses have voluntarily switched to fiber or compostable alternatives, and the Fairfax County Office of Environmental and Energy Coordination promotes voluntary reduction.
There are currently no Fairfax County penalties for using polystyrene foam containers. Future state enforcement will fall on the Department of Environmental Quality once the phase-out activates.
