Plano does not ban polystyrene foam takeout containers. The same Texas Health and Safety Code Section 361.0961 preemption that struck down plastic bag bans applies to local restrictions on foam cups, clamshells, and similar packaging.
Polystyrene foam containers, often called by the brand name Styrofoam, are widely used for takeout food and beverages. Coastal cities in other states have banned them, but Texas Health and Safety Code Section 361.0961 prohibits local governments from regulating containers or packages for solid waste purposes. The Laredo Merchants ruling extends that preemption to bag, foam, straw, and other container restrictions. Plano therefore allows polystyrene at restaurants, grocery stores, and special events with no local fee or ban. The city encourages reuse and recycling but cannot mandate them. Some Plano businesses voluntarily switch to compostable or recycled-content alternatives for branding or sustainability reasons.
There are no Plano fines for using polystyrene foam packaging. Litter from foam containers is still subject to standard littering and illegal dumping penalties under Texas HSC Chapter 365.
