Florida has no statewide plastic straw ban and no straw preemption: Governor DeSantis vetoed the 2019 moratorium bill, so cities and counties may adopt and enforce their own single-use straw ordinances.
The Legislature passed HB 771 in 2019, which would have barred local governments from adopting or enforcing plastic straw ordinances for five years, but Governor DeSantis vetoed it, noting local straw bans had not frustrated any state policy. The bag-and-container preemption in Section 403.7033 covers auxiliary containers, wrappings, and disposable plastic bags, not straws. As a result, coastal communities such as St. Petersburg, Fort Myers Beach, Sanibel, and Miami Beach maintain enforceable restrictions on single-use plastic straws, while state law imposes no straw requirement of its own.
Penalties come only from local ordinances where adopted, typically civil code-enforcement fines that escalate for repeat business violations; no state penalty applies.
