Unlike California, Florida, Texas, and many other states, Pennsylvania has not enacted a solar access / solar rights law limiting HOA authority. Bucks County planned communities including Newtown Grant, Heritage Creek, Flowers Mill, Regency at Yardley, and others may enforce CC&R restrictions on solar panel placement, color, and visibility. HOAs may require architectural review committee approval before installation. Some associations permit rear-roof panels only (facing away from the street). A 2024 Pennsylvania House bill (HB 2323) proposing limits on HOA solar bans did not pass. Homeowners should review CC&Rs and submit plans to the ACC before installing. Community solar subscriptions remain available statewide as an alternative for HOA-restricted homes.
Installing without required HOA approval: association fines typically $25 to $200 per violation plus demand to remove or relocate panels. HOA may pursue injunctive relief through Bucks County Court of Common Pleas. Homeowner remedies against HOA denial are limited absent CC&R violations.
