TX Property Code §202.010 broadly prohibits HOAs from banning solar panels. HOAs may only impose restrictions that do not substantially increase cost (>10%) or decrease efficiency (>10%).
Texas Property Code §202.010 (enacted 2011) declares solar energy device restrictions void unless the installation threatens public health/safety, violates a law, is on common property, or is in a location other than the roof or fenced backyard. HOAs may require installations match roof color where possible, but cannot require ground-mount relocation that reduces output more than 10% or increases cost more than 10%. Homeowners in Stonebridge Ranch, Starwood, Craig Ranch, and other Collin County HOAs have successfully installed rooftop solar over HOA objections using §202.010.
HOA violation of §202.010: owner may recover actual damages, court costs, and attorney fees. Texas AG has issued guidance opinions supporting homeowner rights. HOA fines for non-compliant locations still enforceable if statute conditions met.
