Virginia law generally prevents HOAs from prohibiting solar energy collection devices unless the recorded declaration explicitly contains the prohibition.
Va. Code Section 55.1-1820.1 (POA) and Section 55.1-1951.1 (Condominium Act) provide that no community association may prohibit installation of a solar energy collection device on an owner's property unless the recorded declaration establishes such a prohibition. HOAs may impose reasonable size, place, and manner restrictions. These statutes replaced former Section 67-701 effective October 1, 2021. Restrictions deemed unreasonable include those that significantly raise costs or reduce energy production. The protection applies statewide and overrides conflicting local HOA rules.
HOA fines unenforceable when prohibitions conflict with statute; owners may seek injunctive relief.
