Arizona ARS 33-1816 prohibits HOAs from banning solar panels or imposing restrictions that significantly increase cost or decrease efficiency. Marana HOAs may set reasonable aesthetic standards but cannot effectively prohibit solar installations.
Under ARS 33-1816, Arizona HOAs cannot prohibit the installation of solar energy devices or impose conditions that significantly increase the cost of the system or decrease its efficiency by more than 10 percent. This applies to all HOA-governed communities in Marana, including Dove Mountain, Continental Ranch, Gladden Farms, and other master-planned developments. HOAs may require architectural review and set reasonable standards for panel placement, wiring concealment, and color, provided these requirements do not effectively prohibit solar or add unreasonable cost. HOAs may not require solar panels to be hidden from street view if doing so would significantly reduce energy production. Homeowners should submit architectural review applications but can proceed if the HOA fails to respond within the timeframe specified in their CC&Rs. Marana itself does not impose additional aesthetic restrictions beyond building code safety requirements.
HOA that violates ARS 33-1816: homeowner may pursue legal action. No town-level violations for compliant solar installations.
