Arizona state law (ARS 33-1816) strongly protects homeowners' rights to install solar panels, prohibiting HOAs from banning solar energy devices. HOAs may adopt reasonable rules regarding panel placement but cannot effectively prohibit installation or significantly increase cost. Tucson homeowners in HOA communities benefit from some of the strongest solar access protections in the nation.
Under ARS 33-1816, any HOA covenant, restriction, or condition that effectively prohibits the installation of a solar energy device is void and unenforceable. HOAs may establish reasonable aesthetic guidelines for placement, but the guidelines cannot increase the cost by more than 20% or decrease efficiency by more than 20%. Arizona's solar rights law also protects solar easements (ARS 33-439) preventing neighbors from blocking solar access.
HOAs that attempt to prohibit solar installations may face legal action. Homeowners can sue to enforce their solar access rights under state law. Courts have consistently upheld Arizona's strong solar protections.
