Tucson allows up to two accessory dwelling units (casitas) per single-family lot under UDC Β§6.6.3, with a third permitted on lots one acre or larger if one unit is restricted-affordable. Amendments effective November 21, 2024 brought Tucson into compliance with Arizona HB 2720 (ARS Β§9-461.18) by eliminating parking requirements and reducing minimum side and rear setbacks to five feet.
Under Tucson Unified Development Code Β§6.6.3, an ADU is limited to 75% of the principal dwelling's gross floor area, capped at 1,000 square feet, but every qualifying lot is guaranteed at least 650 square feet regardless of the principal dwelling size. Side and rear yard setbacks are a minimum of five feet, the maximum allowed under ARS Β§9-461.18(B)(5). Two-story ADUs are permitted, and ADU height cannot be regulated more strictly than the principal dwelling in the same zone. Vehicular parking is not required for ADUs. Up to two ADUs are allowed per Family Dwelling lot; lots of one acre or more may add a third detached ADU if at least one unit on the parcel is a restricted-affordable dwelling unit. Building permits are issued by Tucson Planning and Development Services Department (PDSD); ADUs are exempt from commercial site plan, multifamily classification, and street improvement requirements.
Building or occupying an ADU without required PDSD permits can trigger stop-work orders and code enforcement under UDC Article 10. Unpermitted structures must be brought into compliance, removed, or legalized through after-the-fact permits, with associated fees.
