Unlike CA, FL, AZ, PA has not passed a solar rights law limiting HOA restrictions. The PA Uniform Planned Community Act (68 Pa.C.S. §5101) governs HOAs but does not address solar. HOA covenants control. Most Philadelphia neighborhoods are rowhouses without HOAs, but newer condo developments and some gated communities may prohibit or require architectural review.
