Unlike many states, Kansas does not shield rooftop solar from homeowners associations. No statute voids covenants that limit or ban solar panels, so in an HOA subdivision the recorded CC&Rs and architectural rules govern. An association may require screening, dictate placement, or deny an installation if its covenants allow. Reform bills, including Senate Bill 506 in 2024 and Senate Bill 144 in 2025, both died in committee, so no protection currently exists. Homeowners outside an HOA face no such private restriction, only City of Topeka or Shawnee County permits. Kansas does allow recorded solar easements between neighbors under K.S.A. 58-3801, but that does not override an HOA.
An HOA may enforce its recorded covenants against a noncompliant installation, including fines or a removal demand under the CC&Rs. Kansas offers homeowners no statutory defense.
