Philadelphia Code Section 9-208 establishes the sidewalk cafe licensing program administered by the Department of Licenses and Inspections. A sidewalk cafe is defined as an open-air space on the public sidewalk directly abutting a restaurant or PLCB-licensed premises where food is served at tables and chairs. The cafe must be in an authorized area per the code; locations outside authorized areas require a City Council ordinance. Application requires a $20 non-refundable fee applied to the license balance, a site plan, insurance naming the city as additional insured, and Streets Department Right-of-Way Unit approval. Pedestrian clearance requirements: on sidewalks of 13 feet or less, at least 5 feet must remain clear; on sidewalks wider than 13 feet, at least half the sidewalk width must remain clear. The cafe area must be delineated with an approved barrier. Philadelphia also established a permanent streetery program (outdoor dining in the roadway) in 2022, which requires a separate license. Furniture must be removed or secured outside operating hours.
