New York Uniform Code Structure Height Standards

The New York State Uniform Code, adopted under Executive Law Article 18, incorporates the International Building Code with statewide modifications setting maximum building heights based on construction type, occupancy, and fire-resistive rating. These structural and fire-safety height ceilings apply to every municipality except New York City, which has an equivalent code. While zoning-based height limits are a matter of local home rule and can vary, no city may permit a building exceeding the Uniform Code's construction-type maximum heights without sprinklers, fire-resistive construction, or other code-compliant alternatives. The Department of State Division of Building Standards administers the code statewide.
